On Civil Rights: Business shouldn't have to make gender transition cake

Brnovich is leading a coalition in supporting free speech rights of small business owners. "There are many costs of doing business, but they do not include your civil rights," said Brnovich. "Small business owners maintain the ability to express themselves in their words and their work." Jack Phillips declined to make a custom cake celebrating a gender transition because "[i]t would violate [his] religious beliefs to send a message to anyone that he would celebrate a gender transition."

On Corporations: Opposes NASDAQ rule requiring board diversity

Brnovich is leading a coalition of 17 states to urge the court to overturn the U.S. Securities and Exchange Commission's (SEC) approval of a Nasdaq rule that promotes discrimination on boards. The Quota Rule requires boards of Nasdaq-listed companies to have a fixed-number requirement for women and either racial minorities or self-identified LGBTQ+ members. The proposed rule not only conflicts with the federal constitution but undermines state law.

On Crime: Seeks to carry out first executions in Arizona since 2014

Brnovich announced the State's intent to seek warrants of execution for Arizona death row inmates Frank Atwood and Clarence Dixon. "Capital punishment is the law in Arizona and the appropriate response to those who commit the most shocking and vile murders," said Brnovich. "This is about the administration of justice and ensuring the last word still belongs to the innocent victims who can no longer speak for themselves." Arizona has not carried out an execution since 2014.

On Crime: Reject misguided antics in appeals to delay death penalty

On Tax Reform: Let Rescue Plan underwrite state tax cuts without penalty

Brnovich led a coalition of 20 states supporting Ohio's lawsuit challenging the Biden Administration's unconstitutional Tax Mandate in the American Rescue Plan Act that threatens to withhold COVID-19 relief funding from states if they lower taxes in any fashion. "States must stand together and push back against this assault on state sovereignty," said Brnovich. "I am proud to lead this coalition and fight for hardworking taxpayers across the country."
