Antitrust, by Amy Klobuchar: on Technology

Net neutrality must be restored and zealously protected

Net neutrality--the simple idea that internet service providers must treat all internet traffic and communications equally and refrain from discriminating based on the website, platform, user, or content--must be restored and zealously protected. After the Federal Communications commission scrapped the net neutrality rules, I emphasized that the commission's vote will harm the consumers, particularly the rural areas. As I said at the time of that FCC vote, "It will limit competition. And it will hurt small business entrepreneurship and innovation. I will continue to push for free and open internet." This is an issue that I care a lot about, as do millions of other Americans.

The internet must be equally accessible to all households and families-without discrimination, without regard to whether a person lives in a big city, or on a farm, and without favoring big companies over small businesses and individual citizens.

Regulate and hold accountable big tech companies

During the congressional hearings, each CEO got dozens of questions, with David Cicilline, the House Antitrust Subcommittee Chair who has overseen an investigation of the companies' monopoly power. "Some need to be broken up; all need to be properly regulated and held accountable," he said, pointing out that each company controls a "key channel of distribution," whether it be an App Store or an ad market, and uses data gathering to protect and extend its power of private government," he warned.

Stop "patent trolls" who use patents to block innovation

The pejorative term "patent troll" has been coined to capture the situation in which a company or a person acquires patent rights (often through a bankruptcy) not for purpose of manufacturing products but to aggressively sue alleged infringers.

Like me, New York's senior Senator, Chuck Schumer, one of the bill's other co-sponsors, saw the need for something concrete to be done. As Senator Schumer said when we passed the bill, "patent trolls are taking a bill meant to drive innovation and instead using it to stifle job creating businesses around the country. Main street stores, tech start ups and more are being smothered by the abuse that is all too common in our patent system, and it's time for that to end." Both big companies and patent trolls can misuse patents to stifle legitimate competition, and when that happens, it is a real problem-and something that America's founders would not have liked one bit.
