State of Arizona secondary Archives: on Civil Rights

Frank Riggs: Ok for private businesses to decline services to gays

S.B. 1062: The simple fact is that AZ law doesn't give someone the right to sue a private business for religious discrimination or on the basis of their sexual orientation. That's not going to change given our conservative legislature (thank God).

In the much-cited New Mexico case, the gay couple sued the wedding photographer under a New Mexico state law that made sexual orientation (and same sex marriage) a "protected class" and gave the gay couple the right to sue by alleging discrimination on the basis of their sexual orientation. That's the law in New Mexico and 19 other states, but no such law exists in Arizona. Federal civil rights law does not include sexual discrimination, and the 1st Amendment protects freedom of speech and religion.
