On Gun Control: Allow reciprocity for right-to-carry concealed weapons

NRA-ILA summary (National Rifle Association Institute for Legislative Action, who favored this legislation), 6/19/2007:SB237 will allow Nevada to negotiate Right-to-Carry reciprocity agreements with states whose training standards match Nevada's. On June 15, Governor Jim Gibbons (R) signed SB237.

Testimony by Sen. John J. Lee:To residents of Nevada carrying a gun is a right, but it is a privilege for out-of-state people to carry a gun within Nevada's borders. Important elements of S.B. 237 are background check, training, ability to demonstrate proficiency and safety, and an understanding of firearm laws to obtain a carry concealed weapon (CCW) permit. If a person carries a gun into a bar, a federal building, the Nevada State Capitol or behaves badly with it, his CCW permit will be revoked.

On Tax Reform: Don't suspend energy efficient tax breaks impacting budget

SB567: Suspends all state action relating to tax exemptions applicable to energy efficient buildings.

Summary from Las Vegas Review Journal, May 15, 2007:The Legislature swiftly approved Senate Bill 567 to suspend the tax breaks because of concerns that the loss of revenues would hurt school districts and local governments over the next several years. Any loss of school revenues must be made up by the state general fund, thereby affecting the state budget as well.

Veto Message: Gibbons commented that his veto was grounded in the "rushed move" by the State Assembly and Senate to suspend the program, and called for public hearings "where taxpayer concerns can be discussed and debated and the long-term fiscal impact of any tax exemptions or abatements can be carefully analyzed."

Legislative Outcome:Passed Assembly 42-0-0 on May/3/07; Vetoed by Governor Jim Gibbons on May/14/07; Sustained veto Senate 4-17-0 on Jun/4/07

On Crime: Don't let defendant inform grand jury charges were dismissed

Analysis by "Nevada Appeal", June 4, 2007:AB364 would allow a defendant in a criminal proceeding to file a statement with the grand jury if charges against him had earlier been dismissed in a preliminary hearing. That statement could include the fact that a judge had dismissed the charges for lack of evidence or other legal problems. [The lead sponsor] said the change would provide defendants with some fairness by essentially requiring district attorneys to bring new evidence before a grand jury after losing in a preliminary hearing, [and noted that] even the district attorneys had agreed they could live with the change.

Veto Message:The grand jury system is a fair and workable system that protects the rights of defendants and there is no compelling need to change it.

Legislative Outcome:Jun/4/07 Senate 8-13-0 (sustained veto); Jun/4/07 Assembly 31-11-0 (overrode veto).
