James W. Byrd on Gun Control

Don't establish "stand your ground" defense for shootings

HB0168: Establishing and modifying when defensive force can be used; establishing when no duty to retreat exists.

Summary by Wyoming Tribune Eagle, March 18, 2018 The bill establishes that someone may use deadly force in self-defense without retreating in a place where they are "lawfully present" if they "honestly" believe there is an imminent danger of serious bodily injury. Despite the state Legislature's recent decision to pass the proposal, Mead, a former federal prosecutor, expressed reservations before allowing it to become law without his signature. "I believe existing law adequately addresses the concerns raised in the Stand Your Ground Bill," he said in an emailed statement.

Legislative Outcome: Passed Senate 26-4-0 on Mar/9/18; passed House 49-11-0 on 3/10/19; Rep. James W. Byrd voted NO; Governor Matt Mead allowed without signature, on Mar/18/18.
